Right of Withdrawal and Exceptions

Without prejudice to the exceptions set out in Section 8 below, the Customer has the right to withdraw from the purchase, for any reason and without providing any justification, within 14 (fourteen) days from the date of receipt of the Products, pursuant to Article 52 of the Italian Consumer Code, provided that the procedures described below are followed.

If the Customer wishes to exercise the right of withdrawal, they must notify Salumificio di Genga S.R.L. by one of the following methods:

  • By using the standard withdrawal form prepared in accordance with Annex I, Part B of the Italian Consumer Code (as provided for by Article 49(1)(h) of the Consumer Code), or by submitting any other explicit declaration of their decision to withdraw from the contract, and sending it by registered mail with acknowledgment of receipt to:Salumificio di Genga S.R.L.

  • By completing and sending electronically to shop@salumificiodigenga.it the standard withdrawal form or any other explicit declaration of their decision to withdraw from the contract. If the Customer chooses this option, Salumificio di Genga S.R.L. will promptly send confirmation of receipt of the withdrawal on a durable medium (for example, by email), as required by Article 54(3) of the Italian Consumer Code. The withdrawal period shall be deemed respected if the withdrawal notice is sent before the expiry of the withdrawal period specified above.

In the withdrawal notice, the Customer must specify the Product(s) for which they intend to exercise the right of withdrawal. The right of withdrawal may also be exercised with respect to only some of the Products included in the same purchase order. However, the withdrawal must apply to each Product in its entirety; therefore, the Customer may not withdraw only from part of a single Product purchased.

Once the right of withdrawal has been exercised, the Customer must return the Products without undue delay and, in any event, within 14 (fourteen) days from the date on which they informed the Supplier of their decision to withdraw from the contract, by sending the Products to:

The direct costs of returning the Products shall be borne by the Customer. For the purpose of complying with the return deadline, the Products shall be deemed returned when they are handed over to the postal service or courier. The Customer shall bear all risks of loss or damage to the Products during their return shipment to the Supplier.

Upon timely receipt of the withdrawal notice, the Supplier will reimburse the Customer for the returned Products without undue delay and, in any event, within 14 (fourteen) days from the date on which it is informed of the Customer’s decision to withdraw from the contract. The refund will be made using the same payment method used by the Customer for the original purchase. The Supplier may withhold the refund until it has received the returned Products or until the Customer has provided proof of having sent back the Products, whichever occurs first.

The Products for which the Customer has exercised the right of withdrawal must be returned intact and in their original packaging, complete in all its parts (including any packaging and accompanying documentation).

Pursuant to Article 57(2) of the Italian Consumer Code, the Customer shall be liable for any diminished value of the returned Products resulting from handling other than what is necessary to establish their nature, characteristics, and functioning. If, upon receipt of the returned Products, Salumificio di Genga S.R.L. determines that the Products have suffered a loss in value attributable to the Customer, it shall be entitled to deduct the corresponding amount from the refund due. In such case, Salumificio di Genga S.R.L. will notify the Customer within 14 days of receiving the returned Products.

The right of withdrawal cannot be exercised for Products that are expressly indicated as non-returnable at the time of purchase.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the following cases:

  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery;
  • the supply of goods which, after delivery, are inseparably mixed with other items;
  • the supply of goods which are liable to deteriorate or expire rapidly.
